These general conditions of sale apply to all orders placed on the site.
Colonel reserves the right to adapt or modify these general conditions of sale. In the event of modification, the general conditions of sale in force on the day the order is placed will be applied to each order.
Price and payment
The prices are indicated in euros (€) including VAT. They do not include shipping costs. Shipping costs vary depending on the item and are mentioned at the time of checkout. Colonel reserves the right to modify its prices at any time without notice. The products will be invoiced to the buyer on the basis of the prices at the time of the validation of the order.
Payment for purchases is made by credit card (Visa and Mastercard), bank transfer and PayPal. Payment is made directly on our bank's secure server. All data entered to process the payment is encrypted using the SSL protocol.
The seller retains full ownership of the products sold until full payment of the main price, including costs and taxes. As of delivery, the risks of the goods are transferred to the customer. No order can be shipped before receipt of full payment for the products ordered.
Availability and delivery
The product offer is valid while stocks last.
In the absence of availability of the product(s), Colonel undertakes to inform the customer by email as soon as possible. The buyer can then choose to maintain his order, to exchange the unavailable product for another product or to cancel the order. In case of cancellation of the order, the refund will be made within 30 days of purchase.
Subject to product availability, orders will be shipped within 3 to 10 working days (excluding public holidays) for Metropolitan France, and 10 to 30 days for foreign countries.
Orders are shipped by express transport (Colissimo followed with signature, delivery by a carrier with appointment, etc.) depending on the nature and dimensions of the packages. The products are delivered to the delivery address mentioned by the buyer when finalizing the purchase. In the event of an error in the wording of the delivery address by the buyer, Colonel cannot be held responsible for delays or non-delivery of the products ordered. In this case, the costs incurred for the reshipment of the goods will be charged to the buyer.
Receipt of parcels
Colonel informs the customer that it is his responsibility to inspect and open his packages upon receipt of delivery and in the presence of the delivery person. The customer will formalize his acceptance of the delivery by signing the delivery receipt issued by the carrier.
Upon delivery, and particularly for the furniture, the customer or the recipient must imperatively open the package in the presence of the carrier in order to check the condition of the products. In the event of damaged product(s) or broken product(s) resulting from transport, the customer must refuse the package(s) and indicate the anomaly on the return form and inform Colonel as soon as possible. time limit. It is important that the customer indicates on the delivery note the damage observed on the products delivered. If these mentions are not made on the delivery note presented to the customer by the carrier, no complaint can be accepted a posteriori by Colonel.
Withdrawal
In accordance with article L.121-20 of the Consumer Code , the customer has a period of 14 days to exercise his right of withdrawal and return at his own expense the product or products which do not give him satisfaction (are excluded goods made to your request or clearly personalized, such as made-to-measure furniture or sofas or armchairs upholstered with the fabrics of your choice). Products must be returned in their original packaging, in resalable condition. Any product returned damaged will not be refunded.
WARNING : any "personalized" product (choice of fabric, wood color, custom dimensions, etc.) cannot be refunded. The product is not in stock and is specially produced by the manufacturer for the customer.
Responsibilities
The seller cannot be held responsible for the total or partial non-performance of the obligations related to the order in the event of force majeure or fortuitous event.
The photographs and texts reproduced and illustrating the products presented are not contractual. Consequently, the responsibility of the seller cannot be engaged in the event of an error in one of these photographs or one of these texts.
In the online sales process, the seller cannot be held responsible for any direct or indirect damage related to the use of the Internet, such as loss of data, intrusion, virus or other technical problem.
Computing and Freedom
The customer has, in application of the Data Protection Act of January 6, 1978 , a right to access, rectify and delete data concerning him and kept by the merchant.
Applicable right
These general conditions of sale are subject to French law. For any dispute relating to the contract between the seller and the buyer, the Paris court will have sole jurisdiction.
